A Mexican man accused of raping a 13-year-old girl on a Greyhound bus that traveled through Kansas had been deported 10 times and voluntarily removed from the U.S. another nine times since 2003, records obtained by the Associated Press show.
Three Republican senators — including Kansas’ Jerry Moran and Pat Roberts — demanded this month that the Department of Homeland Security provide immigration records for 38-year-old Tomas Martinez-Maldonado, who is charged with a felony in the alleged Sept. 27 attack aboard a bus in Geary County. A February 9, 2017 search using the string “Tomas Martinez-Maldonado raping” returned zero results.
But in response to the letter, Sarah Saldaña, then-director of ICE, stated that 33 of the 121 immigrant convicts accused of “homicide-related offenses” had been released on bond at the discretion of immigration courts. Another 24 were released because ICE was unable to obtain approval to deport them to their countries within the 180-day deadline set by the Supreme Court in 2001.
